Online Showroom Reservation Fee Terms:
1. THESE TERMS
1.1 What these terms cover. These are the terms and conditions on which you reserve your chosen car through the Online Showroom, where the reservation takes place through https://shop.mercedes-benz.co.uk/(the “Website”).
1.2 Why you should read them. Please read these terms carefully before you pay your Reservation Fee (defined below). These terms tell you who we are, how you will pay your Reservation Fee, what to do if there is a problem and other important information.
If you think that there is a mistake in these terms, please contact us to discuss.
2. INFORMATION ABOUT US AND HOW TO CONTACT US
2.1 Who we are. We are Mercedes-Benz UK Limited (trading as Mercedes-Benz) a company registered in England and Wales. Our company registration number is 02448457 and our registered office is at Delaware Drive, Tongwell, Milton Keynes, MK15 8BA. Our registered VAT number is GB 225027008.
2.2 How to contact us. If you have any queries about your reservation, please contact the Showroom listed against your chosen car in the first instance. Otherwise you can contact us by telephoning our customer service department on 08081 565 635 (from a landline) / 0333 220 6603 (from a mobile) or by email at mercedes-benzgeneralenquiries@mercedes-benz.com, quoting your reservation number.
2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address associated with your reservation or online account.
"Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
3. WHO THE WEBSITE IS INTENDED FOR
3.1 The Website is intended for use by private individuals and business customers.
3.2 We accept no responsibility or liability if, for any reason, a technical interruption, fault or site failure occurs on the Website.
4. RESERVING YOUR CHOSEN CAR
4.1 Reserving your chosen car.
4.1.1 You can browse and select your chosen car, and each car will have a corresponding Showroom listed next to it. Once you have found a car you would like to reserve, you should follow through the online process and pay the required Reservation Fee. Once you have completed payment, you will receive confirmation of your reservation, and you will at that stage have the opportunity to set-up your online account (or log into it where it has already been set up) to see details of your reserved car.
4.1.2 Please note that you are unable to accessorise or add optional extras to your chosen car at this stage. Please contact the Showroom listed to discuss this further.
4.2 Payment of the Reservation Fee.
4.2.1 Payment of a £99 reservation fee (or other such sum that shall be notified by us from time to time) (the “Reservation Fee”) notifies us and the Showroom listed of your interest in your chosen car. Payment of the Reservation Fee is made directly to the Showroom listed and reserves your interest in your chosen car with that Showroom for a period of 48 hours (the “Reservation Period”). The Reservation Period may be extended up to a period of 4 weeks at the sole discretion of the Showroom listed against the car. Please contact the Showroom in order to discuss this further.
4.2.2 Please note that payment of the Reservation Fee does not amount to a deposit for the purchase of your chosen car and does not prevent the car from being sold or withdrawn from sale at any time prior to you purchasing or entering into a finance agreement in relation to the car (see clause 13). Where this is the case, the Showroom may offer you an alternative car of a similar specification. If your chosen car is no longer available, neither Mercedes-Benz nor the Showroom listed accept any liability for failure to supply your chosen car, including any costs incurred by you in travelling to or from the Showroom listed.
4.3 Payment Method. Payment of the Reservation Fee is accepted by credit card and debit card via PayPal or Sage Pay (as directed by the Showroom listed) and as set out on the Website. Payment of the Reservation Fee will be taken using the payment card you put forward and you confirm to us that you are authorised to use the payment card that you provide to make the Reservation Fee. The Showroom, and/or your card issuer, may carry out security checking to confirm that this is the case.
4.4 We will confirm receipt of your Reservation Fee. Please note that at this stage your request to reserve your chosen car has been accepted, however, it is not a guarantee to purchase the car. Payment of the Reservation Fee notifies us and the Showroom listed of your interest in your chosen car only.
4.5 Payment provider charges. We are not responsible for any charges or penalties which may be imposed by the payment provider/card issuer in connection with the Reservation Fee as a result of payment being processed and cannot be held responsible for any processing. We do not accept any liability in relation to the processing of your Reservation Fee.
4.6 Refund of the Reservation Fee.
4.6.1 If you decide to cancel: If you decide that you no longer wish to proceed with the reservation of your chosen car you should contact the Showroom listed against the car, or contact us using the details in clause 2.2, and the Reservation Fee will be refunded to you.
4.6.2 If your chosen car is no longer available: If your chosen car is no longer available the Showroom listed against the car will contact you to confirm and the Reservation Fee will be refunded to you.
4.6.3 The refund of your Reservation Fee will be made by the Showroom to whom you made the payment and it will be provided via the method and to the card on which you made the original payment.
4.6.4 Please note that the refund of the Reservation Fee by the Showroom may take up to 10 working days. We accept no responsibility for any delay in your refund being processed.
5. AFTER YOU HAVE MADE YOUR RESERVATION
5.1 Once the reservation has been processed and your Reservation Fee has been paid, your chosen car will be reserved for the Reservation Period. However, as stated above at clause 4.2.2, this will not prevent your chosen car from being sold or withdrawn from sale by the Showroom within the Reservation Period.
5.2 During the Reservation Period the Showroom will make contact with you in order to arrange a viewing and/or test drive. Where your chosen car is no longer available the Showroom may offer you a car of a similar specification.
5.3 Should you proceed to purchasing a car, the Showroom will discuss your options for purchase with you, including financing of the car (see clause 13).
6. DELIVERY OR COLLECTION
6.1 Where you proceed to purchasing or financing your car (see clause 13), delivery or collection of your car will be arranged directly with the Showroom listed. Please note that delivery charges may apply.
6.2 We do not accept liability for any delay or disruption to the delivery or collection of your car.
7. OUR CARS
7.1 Cars may vary slightly from their pictures. Images on the Website may show cars as left hand drive, this is not to UK specification and all cars reserved through the Website will be right hand drive. Whilst we have taken every care to show the true colour of the exterior and interior of our cars, colour deviations may occur as a result of individual screen or monitor resolution and you accept that this is outside of our control, we therefore cannot accept any liability for deviations in colour of the exterior or interior of your chosen car.
8. PRICES
8.1 Price of the cars. The price of the cars shown are on the road prices, except in the case of obvious error. All prices on the Website include VAT at the rate of 20%. Please note that all prices, (including the current rate of VAT and any other applicable taxes) are subject to change, even where a reservation has been made and a Reservation Fee has been paid.
9. YOUR RIGHT TO MAKE CHANGES
9.1 Your right to make changes. If you wish to make a change to or cancel the reservation of your chosen car please contact the Showroom listed. Alternatively, please contact us, via the contact details provided in clause 2.2.
9.2 Extension of the Reservation Period. It may be possible to extend the Reservation Period up to 4 weeks. Please contact the Showroom listed where you have reserved your chosen car in order to discuss your options.
10. OUR RIGHT TO MAKE CHANGES
10.1 Changes to the products or to these terms. We may change the Website and these terms:
10.1.1 to reflect changes in relevant laws and regulatory requirements; and
10.1.2 to implement minor technical adjustments and improvements.
11. HOW WE MAY USE YOUR PERSONAL INFORMATION
11.1 How we will use your personal information. We will use the personal information you provide to us:
11.1.1 to assist the Showroom in processing your payment of the Reservation Fee;
11.1.2 to assist the Showroom in making contact with you to discuss your chosen car and arrange a test drive and/or viewing; and
11.1.2 if you agreed to this during the reservation process, to give you information about similar products or services that we provide, but you may stop receiving this at any time by contacting us.
11.2 We will only give your personal information to other third parties where the law either requires or allows us to do so.
11.3 We will process any personal data in accordance with our Privacy Policy (as updated from time to time).
12. ALTERNATIVE DISPUTE RESOLUTION
12.1 Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you have a complaint about any aspect of the service we have provided, please contact our Customer Services Department. In the event you remain dissatisfied with how we have handled any complaint, you may want to contact the alternative dispute resolution provider we use. You may be eligible to submit a complaint to the Consumer Ombudsman Service, by writing to Consumer Ombudsman Service, PO Box 1263, Warrington, WA4 9RE, by calling 0333 300 1620 or by emailing complaints@consumer-ombudsman.org. The Consumer Ombudsman Service will not charge you for making a complaint. Further information can be found at www.consumer-ombudsman.org.
12.2 European Online Dispute Resolution Platform. Consumers inside the EU now have access to a web-based platform created by the European Commission - the European Online Dispute Resolution Platform ("ODR"). The ODR is a resource dedicated to the out-of-court resolution of disputes in relation to contractual obligations arising out of online purchasing agreements and can provide assistance if there is a contractual dispute.
13. FINANCE
13.1 All finance is subject to status, terms and conditions and lending criteria apply. Applicants must be 18 years or above. Guarantees may be required. Finance is provided by Mercedes-Benz Financial Services UK Limited (trading as Mercedes-Benz Finance), MK15 8BA.
